Next Steps
After you’re charged, released, or detained, your next few appearances will be before a Justice of the Peace, to set a date for trial. The Crown is obliged to provide Disclosure. This is the material accumulated throughout the investigation that outlines evidence against you. You are able to review it, but I cannot provide you with a copy.
Next, the Crown will provide a Screening Form. It outlines the position of the Crown should you plead guilty, or an estimate of the time required for a trial. This process is necessary and solely under the control of the Crown Attorney and not mine.
If the estimate of the time required for a trial excesses a day, then a judicial pretrial will be required. This is a meeting with a Judge, a Crown and myself to assess time and narrow issues. You do not need to attend. After the Judge has approved trial time, we will proceed to court and set a date for a Trial or Preliminary Hearing.

Retainer
After the Screening Form is provided, your matter will be adjourned for a few weeks so that I can be retained. A retainer must be done privately, in cash, or by acquiring a Legal Aid Certificate. This does not affect or limit the service you receive.

Set Date
The next appearance date will be set; either a Trial or Preliminary Hearing. Your hearing date will not likely be for at least 5 months. Clients who remain in custody are given priority dates by the Court and may have a trial within 3 months.

Trial
By this point if I am not yet retained by you, I will not be attending to represent you. A trial date may be set without me going On Record. You can find further details of the Retainer in the Retainer Agreement, that I provide.
